The right to fair trial is a fundamental pillar of a modern state governed by the rule of law. It includes, among other things, the independence of the court and the right to legal representation. As a judge at the Austrian Supreme Court and as its President, Elisabeth Lovrek was responsible for the adherence to these principles. The same issues preoccupy her in her research on civil procedure, especially in the context of insolvency and tenancy law. During the COVID-19 pandemic, for example, it was still necessary to hear all those concerned by a proceeding in person. In this case, the introduction of video hearings guaranteed that fairness is not just a fair-weather idea in everyday court life.
